Govt Official Given 14-Day Ultimatum Over Ksh 7.8B Irregular Spending

The National Assembly Committee on Implementation has initiated the process to account for billions spent irregularly during the pandemic in 2020.

In a meeting with several stakeholders, the MPs directed the Medical Services Principal Secretary, Harry Kimutai, two weeks to establish a multi-agency team to investigate the irregular spending of Ksh7.8 billion.

Led by the Budalangi MP Raphael Wanjala, the committee revealed that the Ksh7.8 billion was spent irregularly by the Kenya Medical Supplies Authority (KEMSA). 

The MPs made the directive after the PS explained that he was not in office during the time in question. However, the committee emphasised that Kimutai should have resolved the matter from where his predecessors left off.

“We cannot continue taking blame because of efficiencies of public officers. We’re giving you two weeks to constitute the team, and to avail the report of that team before this Committee,” Wanjala stated.

Wanjala emphasised that Kimutai’s response was not satisfactory adding that it has been four years since the incident and nothing had been done.

He further told the PS that the shoddy way the team had handled the matter could attract punitive measures against him for non-cooperation.

In response, the PS asked the MPs to give him more time to address the matter. He revealed that he had taken quick action including dispatching correspondences to have recommended agencies to appoint nominees for the multiagency team.

Also in the meeting Twalib Mbarak, the CEO of the Ethics and Anti-Corruption Commission (EACC) informed the committee that the commission had adopted a phased approach to deal with the vast nature of the investigation.

He further explained that EACC had also investigated allegations of public officers who may have been involved in the irregular procurement and payments by KEMSA.

Mbarak however complained that the Director of Public Prosecution (DPP) was derailing the investigation by delaying to decide on the matter. He noted that the commission had concluded its work.

On this, the committee resolved to invite the DPP to clarify the matter noting that the back and forth between the two entities was slowing down the investigations.

Ruto Fires Warning After Signing Affordable Housing Bill Into Law

President William Ruto has warned government employees of dire consequences should corruption scandals emerge in the Affordable Housing Programme.

Speaking during the Signing of the Housing Bill into law at State House Nairobi on Tuesday, March 19, the Head of State asserted that he would not condone any form of corruption citing measures he had put in place to prevent such instances.

Ruto revealed that the government had already agreed on the pricing of building materials, underscoring that there would not be cases of extrapolated prices.

On the other hand, he explained that corruption cannot be allowed in the programme given that Kenyans were making monthly contributions.

He also asserted that corruption would soil the plan which aims to create job opportunities and build affordable houses for Kenyans.

“I want to assure you that I will do whatever it takes to deal with whoever is engaged in corruption. I will protect these resources for the betterment of the people of Kenya.

“I want to give a warning to anybody who steps offline, it is not going to be business as usual. This programme will be corruption-free. We have agreed on the quantities and cost. Unlike in the past when the cost ran over the place, we agreed on the costs, for this one,” he stated.

Notably, the Affordable Housing Act stipulates that anybody who engages in the misappropriation of funds in the programme will be fined Ksh10 million.

Additionally, they will be required to pay a mandatory fine which is twice the money that has been misappropriated.

On the other hand, Ruto also directed the Ministry of Lands to develop guidelines that would see social amenities provided to both women and men working at various construction sites in the country.

He made the remarks after a female contractor complained that there were no changing rooms for women.

Likewise, he called Kenyans to support the programme which he indicated was aimed at creating job opportunities for the youth and eradicating slums.

“My commitment is that in the next 10 years, we shall not have a slum in Kibra, we will have an estate. As we create the housing unit we will move people to live in it,” he stated.

EACC, ODPP & Justin Muturi Gang Up Against Kenya Kwanza MP

The Ethics and Anti-Corruption Commission (EACC), in conjunction with other agencies, has opposed a bill from Mbeere North MP Geoffrey Kariuki Ruku seeking to delete from the law two corruption offences contained in the Anti-Corruption and Economic Crimes Act.

The lawmaker, who is serving his term under Democratic Party allied to the ruling Kenya Kwanza coalition, introduced the Anti-Corruption and Economic Crimes (Amendment) Bill, 2023, seeking to decriminalise sections of the Act including spending public funds in unplanned projects.

The bill seeks to repeal Section 45 (2) which criminalises a person’s decision to use public funds to pay for substandard goods, goods not supplied and services not rendered.

It also criminalises engaging in a project using public funds without prior planning with the lawmaker arguing that the section should be better addressed through administrative action as opposed to criminal prosecution.

In their submissions to the National Assembly’s Justice and Legal Affairs Committee (JLAC) on Thursday, EACC and three other agencies termed the bill retrogressive, dangerous and a backward step in the fight against corruption.

They argued that the two sections exist to protect public funds from embezzlement and to enforce accountability among the public officials involved in the administration of public resources.

“The commission opposes the bill on the ground that decriminalising failure to follow procurement procedures undermines Article 227 of the Constitution, which provides for fairness, equity, transparency and cost-effectiveness in the procurement of public goods and services,” EACC argued.

Other entities opposed to the bill are the Office of the Attorney General (AG), the Office of the Director of Public Prosecutions (ODPP) and Transparency International Kenya (TI-Kenya).

The Office of the Attorney General headed by Justin Muturi argued that the proposed repeal contradicted the institution’s anti-corruption policy.

“By removing (the sections), the proposed amendment removes procurement fraud and malpractices from the ambit of corruption and economic crimes,” Muturi wrote in documents tabled before JLAC and obtained by Kenyans.co.ke.

“As a result, officers who misappropriate public funds through procurement will not be subject to the provisions calling for the suspension of public officers charged with corruption and economic crimes.”

The same sentiments were also expressed by  Director of Public Prosecutions Renson Ingonga who argued that the creation of the offence sought to protect the government of Kenya from potential legal actions.

“The Constitution requires public money to be used in a prudent and responsible way. The test of prudence and responsibility can only be measured against established rules and procedures which can be audited,” Ingonga posed.

The lawmaker had argued that the Constitutional change strengthened the fight against corruption by removing undue criminalisation of procurement flaws which in his view could be adequately dealt with through administrative action.

Al-Shabaab Militants Carry Out Gruesome Attack in Kenya, Leaving Five Civilians Dead, Including a Student

In a horrifying incident, five innocent Kenyan civilians lost their lives as al-Shabaab militants launched a vicious assault on two villages in Lamu County on Saturday evening. The police, along with witnesses, have confirmed the distressing events that unfolded.

The attack occurred at approximately 7:30 p.m. when the armed assailants stormed the villages, forcibly dragging the victims out of their homes. The militants callously tied their hands and legs with ropes, leaving them defenseless before mercilessly executing them.

According to the police report, all the victims of this heinous act were men, one of whom was a student visiting his family during a half-term break.

The attackers, donning military attire and wielding guns, machetes, and knives, initiated their assault as darkness fell upon the villages. They commanded the remaining residents to lie down silently, prohibiting any attempts to raise the alarm. Women were separated from the group and confined to separate rooms before being released unharmed.

“The assailants disappeared into the forest,” reported the police.
