  • Former Senator for Kakamega County Boni Khalwale on Tuesday, January 12, sparked debate among netizens after he shared a post on Facebook endorsing Acting Chief Justice Philomena Mwilu to officially take the helm of the Judiciary.

    Khalwale detailed the lack of women in leadership, a post which seemed to rub the majority of netizens the wrong way.

    “A woman is not going to be President in Kenya any time soon. None has ever served as Speaker of Parliament. Ascending to the helm in the Judiciary is a tall order.

    “And now Justice Philomena Mwilu has emerged. Tuache stori mingi (let’s stop all the fuss), confirm her as our new Chief Justice,” he said.

    The sentiments elicited debate on social media with many criticizing the former Senator’s comments.

    “Mwilu cannot just be confirmed to be Maraga’s successor on the basis of being a woman. There’s a laid down procedure for one to become CJ.

    “Being a woman is no qualification. Let her apply and go through due process.

    “She can’t just be confirmed to be the new CJ just because she is a woman,” part of the comments read.

    Others however were not opposed to Khalwale’s sentiments and lauded him.

    “For the first time I have agreed with you sir, we need sanity in our systems where all individuals are treated equally.

    “She’s fit for the seat and she should be given the position.

    “I agree with you Khalwale, they have always talked of gender inclusivity, now they have Mwilu. She is qualified,” the comments read.

    This comes after David Maraga ceased to be Chief Justice on Tuesday, January 12, and Mwilu took the position in an acting capacity.

    The Justice and Legal Affairs Committee will officially begin the process of recruiting a new officeholder.

    Recently, Activist Okiya Omtata had moved to court to temporarily bar Mwilu from taking over as acting Chief Justice. However, the case was dismissed by Justice Justice Antony Mrima.
